1. The service

Rifa Ya (https://rifayaonline.com) is a software platform that gives individuals and organizations the tools to publish a raffle online: a prize page, an interactive number board, a link to share, order notifications and a dashboard to confirm payments and record the winner. By creating an account, publishing a raffle or buying numbers, you agree to these Terms. If you don’t agree, please don’t use Rifa Ya.

Rifa Ya does not operate raffles, lotteries or games of chance. We are not a party to any raffle and we don’t sell numbers on anyone’s behalf.

2. Who can use Rifa Ya

• You must be at least 18 years old to create an account, publish a raffle or buy numbers.
• If you publish a raffle for an organization (a school, church, team, club or nonprofit), you confirm that you are authorized to act on its behalf.
• You must give accurate information and keep your password safe. You are responsible for what happens under your account.

3. This is not legal advice

Raffle laws in the United States are set state by state (and sometimes by county or city). In many states only qualified nonprofit organizations may hold raffles, often with a license or registration, and there may be rules on prizes, ticket sales, online sales, record keeping and reporting. Anything on Rifa Ya about raffle rules is general information, not legal advice. Before you start, check the rules that apply to you with your state’s gaming or charitable gaming authority, your attorney general’s office or a lawyer.

4. Organizer responsibilities

Whoever publishes a raffle is its sole responsible party and, by publishing it, represents and agrees to:

• Comply with all federal, state and local laws that apply to the raffle, including obtaining any license, permit or registration, and handling any taxes, reporting or prize-winner paperwork.
• Own the prize or be authorized to raffle it, and deliver it to the winner as described.
• Hold the draw on the announced date with the announced method, in a fair and verifiable way, and record the winning number on Rifa Ya.
• Collect and manage the money from the raffle directly, and answer to buyers for it, including any refunds if the raffle is cancelled or postponed.
• Give truthful information about the prize, price per number, number of entries, draw date and draw method.
• Not use Rifa Ya for scams, money laundering, illegal prizes or any activity prohibited by law.

5. Buyer responsibilities

• Before paying, review the prize, the organizer, the price per number, the draw date and the draw method.
• You pay the organizer directly. Keep your payment receipt and your numbers.
• Questions or claims about a specific raffle (an undelivered prize, a draw that didn’t happen, a refund) go to that raffle’s organizer, not to Rifa Ya.
• Make sure that taking part in the raffle is allowed where you live.

6. Payments between buyers and organizers

Buyers pay organizers directly, using whatever methods the organizer accepts (for example Venmo, Zelle, Cash App, PayPal or cash). Rifa Ya never receives, holds or transfers the money for raffle numbers and charges no commission on it. Those payments are governed by the terms of the payment app you use. We can’t reverse, refund or verify them, and we don’t guarantee that a buyer or an organizer will pay or deliver.

7. Paid plans

• Publishing a raffle of up to 100 numbers is free. The Activated and Premium plans are one-time payments per raffle for extra tools, shown on our pricing page in US dollars. They are not subscriptions and they are not a share of your sales.
• Plans are paid through PayPal. We don’t see or store your card details.
• The plan is applied to the raffle you choose as soon as the payment is confirmed. Upgrading an Activated raffle to Premium costs the difference you haven’t paid for that raffle.
• Plan payments are non-refundable, because the tools are delivered right away, except when there’s a billing error on our side (for example, a duplicate charge or a plan that wasn’t applied). In that case, contact us within 30 days and we’ll fix it or refund it.
• If we remove a raffle for breaking these Terms, its plan is not refunded.

8. Prohibited content and conduct

You may not use Rifa Ya to publish or promote:

• Raffles that are illegal where they’re held or sold, or that you aren’t authorized to run.
• Prizes that are illegal or restricted, such as firearms or ammunition, alcohol, tobacco, vapes or cannabis products, prescription drugs, animals, counterfeit or stolen goods, or real estate where that requires special approval.
• Fake prizes, misleading descriptions, rigged draws or anything designed to deceive buyers.
• Content that is sexual, violent, hateful, harassing, or that infringes someone else’s rights (including photos you don’t have permission to use).
• Spam, malware, or attempts to break, overload or misuse the platform.

We may review, hide or remove any raffle or account, without prior notice, if we believe it is fraudulent, illegal or breaks these Terms, and we may cooperate with authorities when appropriate.

9. Disclaimers and limitation of liability

Rifa Ya is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t guarantee that the service will be uninterrupted or error-free.

Because Rifa Ya only provides the technology and isn’t involved in the money, the prize or the draw, we are not a party to the relationship between organizers and buyers and are not responsible for unpaid numbers, undelivered prizes, draws that didn’t happen, scams or any other conduct of organizers or buyers. To the fullest extent permitted by law, Rifa Ya will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, and our total liability for any claim related to the service is limited to the amount you paid us for plans in the 12 months before the claim.

You agree to indemnify and hold Rifa Ya harmless from claims, losses and expenses arising from your raffle, your content or your violation of these Terms or of the law.

10. Changes and termination

We may update these Terms or the service. When we make important changes, we’ll update the date at the top of this page; continuing to use Rifa Ya means you accept the new version. You can stop using Rifa Ya at any time, and you can ask us to close your account. See our Privacy Policy for how we handle your data.
